Car Accidents in California and Personal Injury Claims

California law operates on the legal principle of comparative negligence, which allows for multiple parties to share liability in an accident. If the negligence of either driver is determined to have contributed to the crash, then the other may have grounds for a personal injury claim.

A personal injury claim can compensate for the victim’s medical expenses, lost wages, pain and suffering, and other damages. If negligence on the victim’s part also played a role, any settlement may be reduced in proportion to their share of fault, but that would not keep them from seeking compensation.
